Terms of Use

1. Agreement to Terms

These Terms of Use ("Terms") govern your access to and use of the RacePSL platform, including the website at www.racepsl.co.za, the racer passport service, championship data, and all related features ("the Platform"), operated by RacePSL (Pty) Ltd.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

2. Platform Use

RacePSL grants you a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes in connection with South African motorsport.

To access certain features — including racer passport management and result notifications — you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating an account and keep it up to date.

3. Racer Passport

The RacePSL Racer Passport is a digital identity and career record for registered racers. By claiming a racer passport, you confirm that you are the racer, the racer's parent or legal guardian, or an authorised representative.

Passport fees are payable in advance and are non-refundable once the passport has been activated. Claiming a racer passport does not create any rights to official championship entry, MSA licensing, or race participation. Those remain subject to the requirements of Motorsport South Africa and individual championship promoters.

4. Data Accuracy

RacePSL publishes championship standings and results based on official data provided by championship promoters and event officials. While we take reasonable steps to ensure accuracy, we cannot guarantee that all data is free from error.

Championship standings on RacePSL are for informational purposes. In the event of a discrepancy, official results issued by the relevant championship organiser or Motorsport South Africa take precedence.

5. Championship Promoter Responsibilities

Championship promoters and series administrators who use RacePSL to manage competition data are responsible for ensuring the accuracy of result data submitted to the platform, ensuring appropriate consent has been obtained from competitors, complying with MSA regulations and applicable data protection obligations, and ensuring authorised officials are the only individuals accessing restricted governance data.

RacePSL provides the platform infrastructure. Championship promoters remain responsible for the governance decisions made within their series.

6. Intellectual Property

All content on the RacePSL Platform — including the platform design, software, branding, data structures, result card designs and written content — is the property of RacePSL (Pty) Ltd and is protected by applicable intellectual property law.

You may not reproduce, distribute, or commercially exploit any part of the Platform without prior written permission from RacePSL.

7. Prohibited Conduct

You may not use the Platform to: claim a racer passport fraudulently or without authorisation; scrape or systematically extract data from the Platform; interfere with the operation of the Platform or its infrastructure; impersonate another person, racer or official; submit false or misleading information; attempt to access governance data without authorisation; or use the Platform for any unlawful purpose.

8. Limitation of Liability

To the fullest extent permitted by South African law, RacePSL is not liable for any indirect, incidental or consequential damages arising from your use of the Platform, including reliance on championship data for any purpose beyond personal information.

RacePSL does not make warranties about the uninterrupted availability of the Platform or the real-time accuracy of live competition data.

9. Termination

RacePSL reserves the right to suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or use the Platform in a manner that harms other users or the platform's integrity.

You may close your account at any time by contacting support. Closure of an account does not affect the championship record, which is retained as part of the official competition history.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.

RacePSL reserves the right to update these Terms from time to time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms.
